Welcome to Instant Mobile Notary. By accessing and using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Services Provided

Instant Mobile Notary provides both online and in-person notarization services. Our online services allow you to notarize documents through a secure video call with a certified notary public, while our in-person services involve a certified notary traveling to your location.

2. Fees and Payment

  • Convenience Fee: A $25 convenience fee will be charged for each online notarization session.
  • Late Night Fee: Fees start at $40 and may increase depending on the distance, the time of night, the type of documents, or the nature of the emergency.
  • Travel Fee: A travel fee will be charged based on the distance to the client’s location for in-person notarization services. This fee will be disclosed and agreed upon during the booking process.
  • General Document Execution Minimum Charge: $75.00
  • Estate Document Execution Starting at: $150.00
  • Pre-payment Required: All payments must be made in advance via electronic invoice, Zelle, or PayPal.
  • Accepted Payment Methods: Payments must be made through the electronic invoice system when booking your appointment, or through Zelle or PayPal in person for additional charges.
  • Immediate Payment: Payments must be made immediately to book an online appointment. We will not travel to you or show up to your virtual appointment without payment.

Strict NO REFUND POLICY: All fees are non-refundable. Booking fees are retainers to hold the date on the calendar. If you need to reschedule, please call or text us at 602-680-0637 or use the booking link to reschedule.

3. Scheduling and Appointments

  • Appointments must be scheduled in advance through our online booking system.
  • You are responsible for ensuring that you are available and on time for your scheduled notarization session, whether online or in-person.

4. No-Show Policy

  • If you fail to show up for your scheduled Zoom meeting or in-person appointment, all fees paid will be non-refundable.

5. Identity Verification

  • You must complete a secure identity verification process before your notarization session.
  • Failure to provide valid identification will result in the inability to proceed with the notarization and forfeiture of any fees paid.

6. Privacy and Security

  • We prioritize your privacy and use advanced security measures to protect your personal information and documents.
  • All online notarization sessions are conducted through secure video calls, and your information is handled with the utmost confidentiality.
  • For in-person notarizations, all interactions and documents will be handled securely and confidentially.

7. Legal Compliance

  • Our notaries are certified and comply with all applicable state laws and regulations regarding online and in-person notarization.
  • It is your responsibility to ensure that your documents are legally acceptable for notarization in your jurisdiction.

8. Intellectual Property

  • All content, trademarks, and data on our website and through our Services are the property of Instant Mobile Notary or its licensors and are protected by intellectual property laws. You agree not to use, copy, or distribute any content without our prior written permission.

9. Disclaimer of Warranties

  • Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be uninterrupted or error-free.

10. Limitation of Liability

  • To the maximum extent permitted by law, Instant Mobile Notary and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of our Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our Services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Services; and/or (f) the defamatory, offensive, or illegal conduct of any third party. Our liability is limited to the fees paid for the notarization service.

11. Indemnification

  • You agree to indemnify, defend, and hold harmless Instant Mobile Notary, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of our Services, or your violation of these Terms.

12. Safety and Conduct

  • If during an in-person notarization session, the notary feels harassed, threatened, or unsafe in any way, the session will be immediately terminated.
  • The notary reserves the right to call authorities and pursue legal action if necessary.
  • We have the right to terminate service if we deem it unsafe or if someone is yelling or being disrespectful.

13. Customer Responsibilities

  • You are responsible for ensuring that all information and documents you provide are accurate and complete.
  • You must cooperate with the notary and follow all instructions provided to ensure the successful completion of the notarization process.

14. Force Majeure

  • Instant Mobile Notary will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, war, acts of terrorism, government actions, labor disputes, or technical failures.

15. Governing Law and Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of [Your State].

16. Severability

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Changes to Terms and Conditions
